True Pros Terms & Service
TERMS AND CONDITIONS
1. SCOPE OF WORK
True Pros Heating & Air (“True Pros”) agrees to furnish labor, materials, equipment, and services as described in the approved estimate, proposal, invoice, or agreement. Any work not specifically listed is excluded unless otherwise agreed to in writing.
2. CHANGE ORDERS AND UNFORESEEN CONDITIONS
Customer acknowledges that concealed, unknown, or unforeseen conditions may be discovered during the course of work, including but not limited to ductwork deficiencies, code violations, electrical deficiencies, plumbing issues, structural limitations, asbestos-containing materials, inaccessible equipment, or other site conditions.
Additional labor, materials, or modifications required due to such conditions shall constitute a change order and may result in additional charges. True Pros will make reasonable efforts to obtain customer approval before proceeding with additional work whenever practical.
3. ACCESS TO PROPERTY
Customer agrees to provide safe and reasonable access to all work areas. Delays caused by restricted access, customer scheduling conflicts, pets, personal property, third parties, or unsafe conditions may result in additional charges or rescheduling.
4. SAFE WORK ENVIRONMENT AND RIGHT TO REFUSE SERVICE
True Pros is committed to providing a safe and professional work environment for its employees, subcontractors, and representatives.
True Pros reserves the right to refuse, suspend, or discontinue service and remove personnel from any property where employees or subcontractors encounter unsafe conditions, threats, harassment, discrimination, abusive language, intimidation, unlawful activity, or conduct that reasonably interferes with their ability to perform work safely and professionally.
Customer remains responsible for payment of all authorized work performed, materials supplied, equipment installed, permits obtained, and costs incurred prior to any suspension or discontinuation of services.
5. PAYMENT TERMS
Payment is due according to the terms stated on the approved estimate, invoice, financing agreement, or contract.
Any unpaid balance may accrue interest at the maximum rate permitted by Utah law. Customer agrees to pay all reasonable collection costs, attorney fees, court costs, and lien-related expenses incurred in collecting unpaid amounts.
6. OWNERSHIP OF EQUIPMENT
All equipment, materials, and products supplied by True Pros shall remain the property of True Pros until paid for in full to the extent permitted by law.
7. CODE COMPLIANCE
All work performed by True Pros Heating & Air will be completed in accordance with applicable federal, state, and local building, mechanical, fuel gas, electrical, and safety codes in effect at the time of installation. If existing conditions, equipment, or system components are found to be non-compliant, unsafe, or require modification to meet current code requirements, additional repairs or upgrades may be necessary and may result in additional charges. True Pros Heating & Air is committed to performing all work in a safe, professional manner and will notify the customer of any code-related deficiencies discovered during the course of the project.
8. WARRANTIES
True Pros warrants its workmanship for the period stated on the invoice, estimate, or warranty documentation.
Manufacturer warranties are provided by the manufacturer and are subject to the manufacturer’s terms, conditions, exclusions, registration requirements, and limitations.
Warranty coverage does not apply to misuse, abuse, neglect, acts of God, power surges, frozen pipes, customer modifications, unauthorized repairs, lack of maintenance, improper operation, or conditions beyond True Pros’ control.
9. WARRANTY SERVICE AND CUSTOMER RESPONSIBILITIES
As a courtesy, True Pros may provide reasonable post-installation assistance to help customers understand the operation of equipment, thermostats, controls, filters, and system settings.
If a service visit determines that no defect in workmanship, equipment performance, or covered component exists, True Pros reserves the right to charge its standard service, diagnostic, or trip fee for additional visits.
If conditions at the property create an unsafe or hostile work environment, True Pros may satisfy any applicable warranty obligation through a qualified third-party contractor or other reasonable means.
10. CUSTOMER-SUPPLIED EQUIPMENT
True Pros makes no warranty, representation, or guarantee regarding equipment, materials, thermostats, controls, or products supplied by the customer. Additional labor may be required to install, troubleshoot, modify, or adapt customer-supplied equipment.
11. REBATES, TAX CREDITS, AND INCENTIVES
Utility rebates, manufacturer incentives, tax credits, and other promotional programs are subject to eligibility requirements established by third parties.
True Pros does not guarantee rebate approval, tax credit qualification, processing times, program availability, or funding levels. Customer is responsible for providing any required documentation, signatures, approvals, or information necessary to complete rebate or incentive applications.
12. PHOTOGRAPHY AND DOCUMENTATION
Customer authorizes True Pros to photograph, video record, document, and retain records of equipment, installations, defects, code violations, job site conditions, completed work, and warranty-related issues for quality control, training, safety, permitting, compliance, insurance, legal defense, and company records.
Personally identifying information will not be publicly shared without permission unless required by law.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, True Pros shall not be liable for incidental, indirect, special, consequential, punitive, or economic damages arising from delays, equipment failures, utility interruptions, manufacturer defects, weather events, acts of God, third-party actions, or circumstances beyond its reasonable control.
14. FORCE MAJEURE
True Pros shall not be responsible for delays or failure to perform caused by events beyond its reasonable control, including weather, natural disasters, labor shortages, utility interruptions, material shortages, transportation delays, governmental actions, pandemics, or acts of God.
15. ENTIRE AGREEMENT
These Terms and Conditions, together with the approved estimate, invoice, proposal, financing agreement, warranty documents, and any written change orders, constitute the entire agreement between the parties and supersede prior discussions or understandings relating to the work performed.
